Unique to Hyderabad

Dual State Jurisdiction — Post-Bifurcation Complexity

June 2014 Bifurcation

One DRT, Two States

When the Andhra Pradesh Reorganisation Act 2014 created Telangana from Andhra Pradesh, the judicial infrastructure — including DRT Hyderabad — was not simultaneously bifurcated. DRT Hyderabad became India’s only Debt Recovery Tribunal serving two separate states, each with its own government, High Court, and revenue administration. This creates a uniquely complex legal landscape that no other DRT in India faces.

Appellate Forum

Which High Court Has Jurisdiction?

For Telangana-based borrowers and creditors: writ petitions against DRT/DRAT orders lie before the Telangana High Court (Nampally, Hyderabad 500001). For Andhra Pradesh-based parties: the AP High Court at Amaravati exercises jurisdiction. In cases involving cross-state securities or borrowers with operations in both states, courts have held concurrent jurisdiction. Identifying the correct High Court is the first critical decision in post-DRT litigation strategy.

Our Role

Navigating Both State Systems

Unified Chambers advises creditors on the correct forum, coordinates SARFAESI enforcement across both Telangana and AP revenue districts, files CMM/DM applications before the appropriate district authority in each state, and handles writ petitions before both the Telangana High Court and AP High Court where required. Cross-state NPA accounts are our speciality — we map the complete security and guarantor matrix across both states before advising on recovery strategy.

!
PRACTICE ALERT: Dual-State Revenue Records

SARFAESI possession and auction procedures require compliance with the revenue administration of the state where the secured asset is located. Properties in Telangana must follow Telangana Revenue Department procedures (Dharani portal); properties in AP must follow AP Revenue Department procedures (Meebhoomi). A creditor with mortgaged properties in both states must run two parallel SARFAESI tracks with different CMM/DM applications. This dual-administration complexity requires counsel experienced in both state revenue systems.

Sector Expertise

Genome Valley & HITEC City — Sector NPA Focus

Hyderabad’s two defining economic zones — Genome Valley (pharma/biotech) and HITEC City (IT/ITES/fintech) — generate a distinct profile of NPA cases at DRT Hyderabad that require sector-specific legal knowledge. We also cover infra project NPAs and the state’s large microfinance sector.

Genome Valley

Pharma Company NPA

Genome Valley near Hyderabad hosts more than 200 pharmaceutical manufacturers, API producers, and biotech companies. When these companies default, enforcement requires specialist knowledge: SARFAESI possession of GMP-certified pharma plants; valuation of specialised API manufacturing equipment and cold-chain infrastructure; NCLT CIRP proceedings where pharma brands, DCGI approvals, and drug licences form part of the corporate insolvency estate. We coordinate valuation, possession, and resolution proceedings for pharma NPA accounts in Genome Valley, Medchal, and Patancheru industrial clusters.

HITEC City

IT Sector Guarantor Liability

HITEC City’s IT and ITES companies often borrow against office premises and equipment, with promoter-founders and investor-directors providing personal guarantees. When IT companies face funding shortfalls or contract losses and default, banks must enforce against: (a) the corporate borrower at DRT/NCLT Hyderabad; (b) personal guarantors under SARFAESI and IBC Section 95; (c) office property mortgages through Section 14 CMM proceedings. We advise on ESOP-backed guarantee structures, nominee director liability, and the enforcement of personal guarantees given by NRI founders now resident abroad.

ORR Zone & Metro Adjacent

Infra Project NPA

Hyderabad’s Outer Ring Road (ORR) and Hyderabad Metro corridors attracted large infrastructure and real estate investments, many funded by bank and NBFC loans. Stalled projects along these corridors form a significant category of DRT Hyderabad filings. Enforcement complexities include: converted agricultural land with disputed HMDA approvals; partially completed structures requiring valuation by certified engineers; revenue records in both Telangana and Ranga Reddy District administrations; and competing RERA claims from homebuyers alongside bank SARFAESI actions. Our team maps all encumbrances before advising on the enforcement route.

Telangana MFI Sector

Microfinance NPA

Telangana has one of India’s largest microfinance sectors, with SHG-linked loan portfolios and NBFC-MFI operations concentrated in Hyderabad, Warangal, and Nizamabad districts. Large NBFC-MFIs that borrow from banks to on-lend to SHGs occasionally face portfolio stress and their own NPA events. We represent banks seeking to recover from NBFC-MFI corporate borrowers at DRT Hyderabad and NCLT Hyderabad, including cases involving pledge of NBFC-MFI loan portfolio receivables as security and enforcement against MFI promoters under personal guarantee proceedings.

Why Hyderabad Is Different

Why DRT Hyderabad Requires Specialist Counsel

01

Dual-State Jurisdiction

DRT Hyderabad is India’s only tribunal serving two separate states — Telangana and Andhra Pradesh. Each state has its own revenue laws, district administration, and High Court. Counsel must know when to file before Telangana HC and when AP HC is the appropriate forum for writ reliefs.

02

Sector-Specific Valuation

Pharma plants (Genome Valley), GMP-certified API units, and HITEC City commercial premises require specialist registered valuers whose reports can withstand judicial scrutiny at DRT. Generalist valuations are regularly challenged by borrowers, delaying auction proceedings by 6–12 months.

03

Cross-State SARFAESI Enforcement

When secured assets straddle Telangana and Andhra Pradesh, separate Section 14 CMM/DM applications must be filed in each state district. Telangana uses the Dharani portal for land records; AP uses Meebhoomi. Each system requires different documentation and district-level court appearances.

04

Parallel IBC & DRT Strategy

For Hyderabad’s corporate-sector NPAs (pharma, IT, infra), banks often benefit from running DRT and NCLT tracks simultaneously. The moratorium under IBC Section 14 affects DRT proceedings; strategic sequencing of forum choices can preserve enforcement rights and maximise recovery velocity.

05

DRAT Chennai Appellate Circuit

Appeals from DRT Hyderabad go to DRAT Chennai, not DRAT Delhi or DRAT Mumbai. Counsel must be familiar with DRAT Chennai’s procedural rules, pre-deposit waiver jurisprudence, and the Tamil Nadu-influenced administrative practices of the Chennai bench — a distinct skill set from DRT-level advocacy.

06

Post-Bifurcation Legal Uncertainty

Several areas of NPA law remain unsettled in the Telangana/AP context: which High Court has jurisdiction for assets spanning both states; how revenue records in one state affect enforceability in the other; and how state government schemes (debt relief, waiver notifications) interact with SARFAESI rights. These areas require experienced counsel who track both state-level developments.

Frequently Asked

DRT Hyderabad — Common Questions

Where is DRT Hyderabad located?+

DRT Hyderabad is located in Hyderabad, Telangana. It is unique among all Debt Recovery Tribunals in India as it exercises dual-state jurisdiction — it handles debt recovery proceedings from both Telangana and Andhra Pradesh following the 2014 state bifurcation. Borrowers and creditors from cities including Hyderabad, Warangal, Karimnagar (Telangana) and Vizag, Vijayawada, Guntur (Andhra Pradesh) all fall within DRT Hyderabad’s territorial jurisdiction.

Why does DRT Hyderabad have jurisdiction over both Telangana and Andhra Pradesh?+

When Telangana was carved out of Andhra Pradesh in June 2014, the administrative infrastructure — including judicial tribunals — was not immediately bifurcated. DRT Hyderabad, which previously served undivided Andhra Pradesh, continued to serve both successor states. This dual-state mandate creates unique jurisdictional complexities: a creditor holding securities in both Telangana and AP, or a borrower whose units straddle the state border, must navigate filings that affect both jurisdictions. Specialist counsel familiar with both states’ property laws, CMM/DM procedures, and High Court practices is therefore essential.

How are pharma company NPAs recovered at DRT Hyderabad?+

Genome Valley (near Hyderabad) hosts over 200 pharmaceutical manufacturers. When a pharma company defaults, secured creditors (banks, NBFCs) pursue: (a) SARFAESI possession of factory land and plant — requiring CMM/DM orders given the complexity of pharmaceutical manufacturing assets; (b) DRT OA filing to recover the outstanding debt with interest; (c) NCLT/IBC proceedings if the pharma company is a registered corporate entity. Valuation of GMP-compliant pharma plants and API equipment requires specialist registered valuers, and our firm coordinates the full enforcement chain.

What is HITEC City’s role in Hyderabad DRT filings?+

HITEC City — Hyderabad’s technology and financial services hub — generates a specific category of DRT filings involving: (a) office space mortgage defaults on large commercial real estate loans; (b) IT/ITES company working capital defaults where promoter-directors have given personal guarantees; (c) startup and co-working space operators defaulting on equipment or lease financing. Banks with large HITEC City loan books — including SBI, HDFC Bank, ICICI Bank and Kotak — regularly file at DRT Hyderabad for recovery of these specialised assets.

Can a Vizag (Andhra Pradesh) matter be filed at DRT Hyderabad?+

Yes. Vizag (Visakhapatnam) falls within the territorial jurisdiction of DRT Hyderabad, as Andhra Pradesh is covered by this bench. Section 19(1) of the RDDBFI Act allows filing where the cause of action arises or where the defendant resides. Banks with Vizag branches regularly file recovery applications at DRT Hyderabad. Our firm handles Vizag-related DRT filings including port-sector infrastructure NPAs, fishing industry loans, and real estate mortgage defaults in the Vizag corridor.

What is the pre-deposit requirement for DRAT Chennai appeal from a DRT Hyderabad order?+

Under Section 18(1) of the RDDBFI Act (as amended), an appeal before DRAT Chennai against a DRT Hyderabad order requires a pre-deposit of 75% of the amount determined by DRT. The pre-deposit may be waived or reduced by DRAT on application, if the appellant demonstrates genuine financial hardship and a meritorious case. Our firm regularly appears before DRAT Chennai in Hyderabad-circuit appeals and advises on pre-deposit waiver strategy.

How does IBC Section 7 interact with DRT proceedings in Hyderabad?+

DRT OA proceedings and IBC Section 7 CIRP petitions are parallel tracks available to financial creditors. Once NCLT Hyderabad admits a Section 7 CIRP petition, Section 14 IBC triggers an automatic moratorium — all DRT/SARFAESI proceedings against the corporate debtor are stayed. However, proceedings against personal guarantors are not covered by the corporate moratorium. Banks in Hyderabad frequently run both tracks simultaneously for complex NPA accounts, particularly in the pharma and infra sectors.

Are infra project NPAs handled at DRT Hyderabad or NCLT?+

The forum depends on the legal structure of the borrower. If the infrastructure borrower is a registered company, financial creditors may choose between DRT OA under RDDBFI Act or IBC Section 7 CIRP at NCLT Hyderabad. If the borrower is a partnership firm or individual promoter, NCLT has no jurisdiction. For ORR zone road and real estate projects, courts must also consider HMDA regulations and revenue records — complexities our firm handles routinely.

What cheque bounce courts are available in Hyderabad?+

Cheque bounce cases under Section 138 of the Negotiable Instruments Act are filed before Judicial Magistrate First Class (JMFC) courts in Hyderabad. The principal venues are: Hyderabad City Civil and Sessions Court (Nampally); additional metropolitan magistrate courts across Secunderabad, LB Nagar and Kukatpally. For corporate borrowers, cheque bounce proceedings often run alongside DRT OA and SARFAESI actions — our firm coordinates all three tracks to maximise recovery pressure.

Can the Telangana High Court stay a DRT Hyderabad auction?+

Yes. The Telangana High Court exercises writ jurisdiction under Article 226/227 of the Constitution over DRT Hyderabad proceedings affecting Telangana-based parties. A borrower challenging a SARFAESI auction may file a writ petition if procedural violations are evident or if the DRT/DRAT remedy has been exhausted. Courts apply the balance of convenience test and typically require deposit of a portion of the admitted debt before granting an interim stay on auction proceedings.

What court fees apply for DRT Hyderabad filings?+

DRT court fees follow the national schedule: ₹12,000 for claims up to ₹10 lakh; ₹17,000 for ₹10–50 lakh; ₹20,000 for ₹50 lakh to ₹1 crore; ₹25,000 for ₹1–10 crore; ₹30,000 for claims above ₹10 crore. These fees apply equally at DRT Hyderabad as at other DRT benches across India. Our firm provides a complete cost estimate at the outset of every engagement.

How does SARFAESI enforcement work for properties near ORR (Outer Ring Road) Hyderabad?+

High-value properties along the Hyderabad ORR zone require specialist SARFAESI enforcement due to: (a) complex title — many ORR-adjacent properties have converted land use requiring careful title verification; (b) valuation complexity given rapid price appreciation in this corridor; (c) HMDA (Hyderabad Metropolitan Development Authority) approvals must be verified and disclosed in auction notices; (d) Section 14 CMM/DM applications may face representations from borrowers citing incomplete approvals. Our firm coordinates certified valuers, title searches, and CMM proceedings for ORR-zone SARFAESI enforcements.
