IBC 2016 / NCLT

IBC Section 7 CIRP Petition — Documents Checklist

Practitioner Note — NCLT must admit/reject within 14 days of filing. Minimum default threshold is ₹1 crore (raised by 2020 notification). IBC Section 7 and DRT OA can run in parallel — choose forum strategically based on asset security and timeline.

NI Act — Section 138

Section 138 Cheque Bounce Prosecution — Checklist

  • Original dishonoured cheque with bank endorsement (reason for return)

Guarantor & Personal Insolvency

Promoter & Personal Guarantor Liability — Action Checklist
